How to Get Southampton Arrest Records

You get Southampton arrest records through a FOIL request. The Freedom of Information Law gives you the right to ask for government records from any local or state agency. The police department must respond within five business days. If they need more time, they have to put it in writing with a reason and a date. Copies run $0.25 per page for requests over five pages.

Southampton Arrest Record Sealing

New York's Clean Slate Act took effect November 16, 2024. It gives OCA up to three years to set up automatic sealing for certain older convictions. Sex crimes and non-drug Class A felonies will not be sealed. Law enforcement and certain approved entities still see the full record. Until OCA finishes, all convictions still appear in the DCJS records system.

For youthful offenders aged 16 to 18 at the time of the crime, CPL §720.35 provides automatic sealing. The court grants YO status at sentencing. A YO finding is not a conviction. All records get sealed, and they cannot be shared with the public. Correction Law §9 requires DOCCS to remove non-violent offender info from its site three years after they finish their sentence.
